Few have heard about the Northern Plains Heritage Area, but many are affected. The federal government just gave a non-profit the go-ahead to “manage” more than 500,000 acres of land. Most landowners never saw it coming. Read about it below.

In other words, the NPHF will create a plan (in many cases in collaboration with the local governing entities) and use federal funding to provide their allies with enough money to twist the arms of local officials to adopt the plan, which will contain many land use restrictions. The long term goal of the National Parks Service may be to turn the area into a national park. Property rights will be denied.

Potter: It’s a virtual area, it actually doesn’t exist
Property owners are still not going to be affected, Potter, contends, because the NPNHA is “a virtual area. It doesn’t exist.” Clearly, the area exists because the law says it does. What is unclear is how willing local governments will be to change their comprehensive plans, land use plans, and other zoning ordinances to receive the federal money.

Northern Plains Heritage Area’s Dubious Process of Designation
Northern Plains Heritage Foundation Director and North Dakota State Senator Tracy Potter organized a lobbying effort to get more than half a million acres of private property designated as the Northern Plains Heritage Area in March, by the US Congress, without disclosing such efforts to the IRS, which is required by law. He also convinced a congressional subcommittee, in 2007, that such a designation had widespread public support, when it did not.

Property Rights Thwarted by Dorgan, Congress
“This is the biggest regulatory taking in the history of North Dakota,” ND Farm Bureau board member Wes Klein said. “Theodore Roosevelt National Park is only 70,000 acres. This bill took half a million acres of private property from Huff Hills to the north end of the Knife River Indian Village and handed it over to a public foundation (the Northern Plains Heritage Foundation). It gave them the right to write a management plan for private property.”
